CHESNUT, District Judge.

This suit was originally filed on November 26, 1946 by Paul A. Porter, Administrator, against the defendants as landlords, to compel a refund of overcharges for rent, pursuant to a retroactive order of the Price Administrator effective 30 days after October 27, 1944. As the suit was not brought until more than a year after the effective date of the order for refund, the question is whether it is not barred by the one-year limitation for such suits, to be found in the Emergency Price Control Act, as amended, 50 U.S.C.A.Appendix, § 925(e).
