On October 30, 1945, an information was filed in the Fourth judicial district court of the State of Nevada, in and for the county of Elko, charging the appellant, Albert Everett Sala, with the crime of murder in the first degree. It was alleged in said information that the said Sala, on the 7th day of September 1945, about 5.4 miles east of Boone Springs, in the county of Elko, State of Nevada, did then and there willfully, deliberately, and premeditatedly, with malice aforethought and with the intent then and there to kill one Edward Alfred McCol-lum, strike…
