hln 1994, Defendant Timothy L. Shaw was convicted of second degree murder, committed by him when he was a juvenile. He received the mandatory sentence of life imprisonment without benefit of probation, parole dr suspension of sentence. His conviction and sentence were upheld on appeal. Following the per. curiam decision' rendered by the Louisiana, Supreme Court in State v. Montgomery, 13-1163 (La. 6/28/16), 194 So.3d 606 (“Montgomery per curiam”), Defendant filed a motion to correct an illegal sentence.
