These are consolidated appeals in which the facts are stipulated and a single question of law is presented.

The plaintiffs were employees of A1 Clements Lumber Company, which had entered into a contract with the City of Portland through its Department of Public Docks for the launching of a boat owned by the lumber company at a dock known as Terminal No. 1, operated by the City.
