Diane Fouche filed suit against the Jekyll Island-State Park Authority [“the Park Authority”], 1 alleging that she had been discriminated against on the basis of her sex, in violation of 42 U.S.C.A. § 1983 and Title VII of the Civil Rights Act of 1964, 42 U.S.C.A. § 2000e et seq. She also asserted a pendent state claim under O.C.G.A. § 51-12-6. Her complaint sought damages and injunctive relief. The district court dismissed the suit, holding that the Eleventh Amendment barred the Section 1983 claim, and that it did not have jurisdiction of the Title VII claim because…
