OPINION AND ORDER
BERTELSMAN, Chief Judge:
The force and scope of Kentucky Revised Statute 411.051 as it relates to this action again comes before this court. This time the plaintiff challenges the constitutionality of the statute under the Constitution of the Commonwealth of Kentucky. This court certified this question to the Kentucky Supreme Court pursuant to Kentucky Civil Rule 76.37(1), but the Supreme Court declined to accept the certification.
