This action was brought in June, 1896, for the purpose of recovering the sum of $269.24, upon an allegation that, the defendant drew a' draft upon the plaintiffs for said sum, which was duly honored by them,, and" “ said sum was advanced and paid out by plaintiffs to the defendant, and received by him as a loan.” The defendant, answered, denying the cause of action, and then by way of counterclaim set up an agreement between himself and the ■ plaintiffs, whereby the latter, employed him as their assistant buyer for a term mentioned in the above answer,, 'agreeing to pay him a salary for said…
