Norfolk County Circuit Court

Decided December 16, 1997No. Case No. CR95001106-00Published

1Opinion of the Court

By Judge Lydia Calvert Taylor

The defendant in this case was charged with conspiracy to commit robbery, first degree murder, two counts of use of a firearm while committing a felony (to wit, murder and attempted robbery), and attempted robbery. A bench trial before this court was held on August 20 and 21, 1997. This court did not issue a finding at that time, but took die matter under advisement. For the reasons stated in this letter opinion, this court finds the defendant guilty of second degree murder and one count of use of a firearm while committing a felony (to wit, murder).
