OPINION

BELL, J.

This is a damage suit for physical injuries which plaintiff claims to have sustained when struck and run over by defendant’s automobile on the West End road, within the city limits of New Orleans. There was judgment for plaintiff for $3500.00. Defendant has appealed.

The event which led to the unfortunate occurrence finds its origin in one of the so-called soft drink saloons of New Orleans, situated at the corner of Toledano and Magazine streets.
