Pending before the court is the United States’ (“the government”) motion for summary judgment under Rule 56 of the Rules of the United States Court of Federal Claims (“RCFC”) in this action brought by plaintiff Dr. Ralph J. Lamson (“Dr. Lamson”) under 28 U.S.C. § 1498(a). This is a ease of first impression in which the court must determine whether the medical immunity provision of 35 U.S.C. § 287(c) applies to the United States.
