Appeal from a judgment of the County Court of Ulster County, rendered November 30, 1978, upon a verdict convicting defendant of two counts of the crime of murder in the second degree. The body of Edward Cuzzi was found on the morning of November 28, 1977, floating in the water under a bridge located on Route 209 in Hurley, New York. An autopsy *741revealed that the deceased had been shot three times at close range in the left rear side of the head.
