Appeal from Second Judicial District Court, Parish of Bossier; John N. Sandlin, Judge. Action between Thomas B. Simpson against Mary E. Bulkley. From a judgment for the latter, the former appeals.

The wife of William B. Simpson died intestate on the 18th of May, 1892, leaving two minor children, John S. Simpson, and the present plaintiff. In July of that year, William B. Simpson, father of the children, qualified as their natural tutor with power of administration, and letters of tutorship were issued to him accordingly. On the same day, Thomas M. Vaughan, a maternal uncle of the children, was appointed and qualified as their undertutor, and letters were issued to him as such.
