Appellant, Safeway Stores, Incorporated, defendant below, appeals from an order of the trial court denying its motion for judgment notwithstanding the verdict and, alternatively, for a new trial. Appellees, Tommy L. Barrett and Theodore A. Burbidge, II, plaintiffs below, brought this case under § 301 of the National Labor Management Relations Act, 29 U.S.C. § 185 (1970), asserting that Local No. 782, Retail Clerks International Association, AFL-CIO (Union) had violated its duty of fair representation by failing to take their grievance to arbitration and that Safeway had breached its contract…
