—In an action to recover under an insurance policy, the defendant appeals, as limited by its brief, from so much of an order of the Supreme Court, Queens County (Posner, J.), dated May 11, 1992, as denied its motion for an unconditional order of preclusion and for summary judgment.

Ordered that the order is affirmed insofar as appealed from, without costs or disbursements, on condition that the plaintiffs attorneys personally pay the defendant’s attorneys the sum of $1,000 within 20 days after service upon the plaintiffs attorneys of a copy of this decision and order, with notice of entry; and…
