This matter came to be heard on June 3-5, 2014, upon Plaintiffs’ Complaint for Declaratory Action and Injunctive Relief. Count I is an action for Nuisance and Prospective Nuisance. Count II is an action for Intentional Trespass. The Court heard the opening statements of counsel and heard testimony of the witnesses. Thereafter, both parties submitted post-trial memorandum briefs, which the Court has now had an opportunity to consider along with the evidence presented at trial and the exhibits.
