This is an appeal from a judgment of the Seventy-Third district court of Bexar county, in which the court held that both parties held liens on lot No. 312, in the town of Fredericks-burg, Gillespie county, Tex., but that the lien of defendant in error was prior to the one held by plaintiff in error.

The trial court at the request of plaintiff in error filed findings of facts, which we will here quote, as we feel that such findings present the peculiar facts relative to the position occupied by the parties:
