In the present dispute, Plaintiff Sylvia’s Haven, Inc. (“SHI”), a non-profit homeless service provider, alleges that defendant Massachusetts Development Finance Agency (“MassDevelopment”) violated various federal and state laws in its effort to evict SHI from property that was formerly part of Fort Devens. Defendant filed a motion to dismiss Plaintiffs case for lack of subject matter jurisdiction which was referred to Magistrate Judge Robert B. Collings for resolution.
