MEMORANDUM AND ORDER

MacLAUGHLIN, District Judge.

This matter is before the Court on the appeal of First National Bank of Anoka from a June 2, 1989 order and judgment of the United States Bankruptcy Court. The judgment will be affirmed in part and reversed in part and remanded.

INTRODUCTION

On January 6, 1984, First National Bank of Anoka (Bank) and Minnesota Utility Contracting, Inc.
