Appeal by the defendant, Jacob Rothschild, from a judgment of the Supreme Court in favor of the plaintiffs, entered in the office of the clerk of the county of Kings on the 27th day of March, 1900, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 11th day of April, 1900, denying the defendant’s motion for a new trial made upon the minutes.

A careful consideration of the opinion of the court, written by Mr. Justice Woodward, fails to secure my concurrence, and for these reasons: . ■
The action is for damages sustained by the plaintiffs by reason of’ their eviction from premises at the corner of Fulton and Jay streets, Brooklyn. Prior to June, 1898, the defendant was the owner of the land and had erected thereon a large eight-story building, with two cellars.
