Plaintiff, Wayne Eaves, sustained crushing injuries to both hands on August 8, 1983, while assisting in the repair of an industrial lift truck at his place of employment. At the time of the accident, plaintiff was attempting to replace a chain that had come off of its sheave. Plaintiff filed strict product liability and negligence claims against Hyster Company (defendant), the manufacturer of the vehicle. The strict liability counts were later found to be untimely and dismissed. In his first amended complaint at law, plaintiff alleged negligence on the part of defendant in defendant’s failure…
