On July 29, 2005, the plaintiff, Steven W. Garland, delivered a truckload of liquid asphalt to the defendant, Shoosmith Bros., Inc. (Shoosmith), in Chesterfield, Virginia. Due to the defendant’s alleged negligence, the plaintiff suffered personal injuries, loss of income, and other damages. The plaintiff filed a Motion for Judgment in the Circuit Court of the City of Hopewell on April 6,2007.
