On June 17, 1969, the petitioner took a competitive promotional civil service examination for Assistant Right-of-Way Agent. On August 16, 1969 he was notified that he had received a final rating of 86.5, which placed him fifth in rank on the promotional list. On August 21, 1969, the Department of Transportation (the appointing agency) notified the petitioner that he had been certified by the Department of Civil Service as qualified for appointment by virtue of the results of his examination.
