Defendant appeals as of right from his conviction after jury trial of involuntary vehicular manslaughter, MCL 750.321; MSA 28.553, and his conviction after bench trial of being an habitual offender, third offense, MCL 769.11; MSA 28.1083, for which he was sentenced to eight to thirty years in prison. We affirm in part and reverse in part and remand.

Defendant’s conviction stemmed from an automobile accident involving defendant as the driver of one car and Stephen Creasap as the driver of the other. Brian Dibble, Creasap’s passenger, was killed in the collision between the two cars.
