Smithfield Trust Company (hereafter “Smithfield”) moves for relief from the automatic stay in the instant bankruptcy ease (Doc. No. 25) so that it may then pursue to completion a request for a constructive trust that it made in a proceeding that it commenced pre-petition in the Pennsylvania Court of Common Pleas, Allegheny County, Orphans Court Division (hereafter “the Orphans Court”).
