This is an action for divorce. The parties were married on May 22, 1983. There are two children of the marriage: Rachel, born July 18, 1984, and Liza, born May 27, 1987. The wife’s complaint served in June 2000 seeks a divorce on the grounds of adultery and cruel and inhuman treatment. The complaint also asserts third, fourth and fifth causes of action sounding in negligence, fraud, battery and misrepresentation, seeking compensatory damages of $1 million.
