In a proceeding pursuant to CFLR article 78 to review a determination of the Board of Trustees of the New York City Employees’ Retirement System dated June 9, 2006, which denied *548the petitioner’s application for disability retirement, the petitioner appeals from a judgment of the Supreme Court, Kings County (Saitta, J.), dated December 27, 2007, which denied the petition and dismissed the proceeding.
Ordered that the judgment is reversed, on the law, with costs, the petition is granted, the determination is annulled, and the matter is remitted to the Board of Trustees of the New York City…
