Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of the Comptroller which denied petitioner’s application for accidental disability retirement benefits.
In May 1990, petitioner applied for disability retirement benefits pursuant to Retirement and Social Security Law § 507-' a, alleging that as a result of an on-duty accident on October 7, 1988 she was permanently incapacitated from performing her duties as a Correction Officer.
