OPINION
By GEIGER, J.
This matter is before this court on appeal on questions of law from a judgment of the Court of Common Pleas wherein *601that Court on motion of the defendant, after the introductions of his evidence instructed the jury to return a verdict in favor of the defendant, and the same having been done, judgment was so entered, from which appeal is taken to .this Court.
