These consolidated cases involve claims for survivors’ benefits under the Black Lung Benefits Act (“BLBA”), 30 U.S.C. § 901 et seq., filed by Respondents Virginia E. Richards and Mary Ellen Morgan. In both cases, Department of Labor (“DOL”) Administrative Law Judges (“ALJs”) awarded the survivors’ claims, and the DOL Benefits Review Board (the “Board”) affirmed.
