This action was commenced in the Lake Circuit Court by the trustee in bankruptcy of the Northern Indiana Oil Company, Inc. (appellant herein) alleging a conspiracy to defraud entered into by the appellees herein, and seeking to recover possession of real estate leased by the appellant, and the profits of said business during the period of the appellees’ illegal possession ; and the going business of the corporation.
