BAUGH, Justice.
Clyde McIntosh, beneficiary in a $2500 life insurance policy issued on the life 'of his brother, W. C. McIntosh, brought this suit against plaintiff in error, hereinafter designated as the Insurance Company, •on said policy. The Insurance Company pleaded forfeiture for non-payment of premiums. In reply plaintiff pleaded waiv,er of such payment, and a course of dealing constituting an estoppel against the Insurance Company to set up non-payment ■of premium.
