MEMORANDUM-DECISION, FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER

Presently before the Court for confirmation is the Chapter 13 Plan (“Plan”) of Penny Corino (“Debtor”) filed on March 31, 1995, and a motion by Binghamton Savings Bank (“BSB”) seeking abstention and dismissal of Debtor’s case pursuant to § 305(a) of the Bankruptcy Code (11 U.S.C. §§ 101-1330) (“Code”).
