This is an appeal from a judgment on the pleadings in favor of defendant.
The complaint alleges that ever since the 8th day of December, 18U, the plaintiffs have been and now are the owners in fee, and entitled to the possession, of the Eittenhouse quartz lode, situate in the Montana mining •district, Beaver Head county, which is described by metes and bounds, corners and distances, containing *97fourteen acres and ninety-hundredths of an acre of land, more or less, and embracing fifteen hundred linear feet of the Rittenhouse lode, to wit, eight hundred and sixty-three feet southerly,…
