MEMORANDUM OPINION

RANDALL L. DUNN, Bankruptcy Judge.

On April 6, 2009, I heard evidence and argument at the final evidentiary hearing (“Hearing”) on Pivotal Solutions, Inc.’s (“Receiver”) Motion to Dismiss Bankruptcy Case, or in the Alternative, to Excuse Compliance with 11 U.S.C. § 543 1 (“Motion to Dismiss”), in which the Bank of Wyoming (“Bank”) joined.
