This suit was brought by Robert Carstairs, defendant in error (plaintiff in the trial court and appellant in the Court of Civil App'eals), as sole devisee and legatee of his deceased wife, Elizabeth Carstairs, a daughter of J. H. Nail, deceased, to establish a constructive trust and to recover a one-fourth .interest in the estate of said J. H. Nail, against W. P.
