PARKER, Justice.
Junius Guillory sued Levingston Shipbuilding Company for personal injuries he sustained while working aboard the tug “Lou Ann Ellis”, a vessel owned by Harms Marine Service. At the time of his injury, the plaintiff was an employee of Levings-ton. Levingston was a subscriber under the Texas Workmen’s Compensation Act, Article 8306 et seq. Texas Revised Civil Statutes, and the Longshoremen’s and Harbor Workers’ Compensation Act, 33 U.S.C.A., Section 901 et seq.
