*67Daisy Betances is charged in two indictments with selling, on each occasion, three vials of crack/cocaine to an undercover officer. In November of 1996, Ms. Betances was found unfit to proceed, pursuant to CPL article 730, and committed to the custody of the Commissioner of the Office of Mental Health (Commissioner) for one year for “care and treatment in an appropriate institution”.
