Harvey, J.:

The Morton Salt Company, having paid income taxes for the years 1933 to 1936, inclusive, filed with the state tax *651commission a claim, and an amended claim, for a refund of parts of the taxes paid. These claims were heard by the tax commission and denied. The taxpayer appealed to the district court, where judgment was rendered for respondent, and it has appealed to this court.
