Schaff. as receiver of the properties of tlie Missouri, Kansas & Texas Railway Company, prosecutes this appeal to reverse' the judgment of the superior court of Pottawatomie county rendered in favor of Henry Tinkle awarding him $125 damages for the alleged wrongful killing of seven bead of hogs, which were killed by one of the defendant railr< ad company’s trains on or about- ttlie 23d day of December, 1920.
