GOLDBERG, Justice.

The City of Providence (city) and Bears Brothers Realty, a Rhode Island general partnership (Bears Brothers), (cohectively defendants), are before the Supreme Court on appeal from a declaratory judgment in *607favor of the plaintiff, First Bank and Trust Company (First Bank or plaintiff)1 that followed the city collector’s scheduled tax sale of several unimproved parcels of land.2 The judgment was based upon the trial justice’s interpretation of G.L.1956 § 44-9-1.3 Codefendants James J.
