Cross appeals from an order of the Supreme Court (Benza, J.), entered January 26, 2005 in Albany County, which, inter alia, partially granted defendants’ motion for summary judgment dismissing the complaint and denied plaintiffs cross motion for partial summary judgment dismissing certain affirmative defenses.
