In their First Amended Original Petition, the pleadings on which they went to trial, R. A. Wilbanks, whose given name was Robert, G. C. Wilbanks, whose given name was Gilbert, Blondine Wilbanks, Darwin Wilbanks, and Caroline Wilbanks Tilger, joined by her husband, B. J. Tilger filed suit against William A. Wilbanks, appellant, and F. M. Wilbanks, Jr. alleging that, “On March 13, 1950, and for sometime prior thereto, E. R.
