In my view, the main opinion misapprehends the meaning of the “in-need-of-care- and-supervision” requirement of Ala.Code 1975, § 12-15-l(10)n. In the process, the Court today renders null time-honored jurisprudence that extends to well before the creation of the State Department of Human Resources and the enactment of the Alabama Juvenile Justice Act and that, until today, has served to limit the reach of the State through these mechanisms.
