Gentlemen of the jury:—This is an action brought by William C. Short, administrator of Charles A. Short, deceased, for the recovery of damages sustained by the estate of said deceased on account of his death which is alleged to have been caused by the negligence of the defendant company on the twelfth day of December, 1906.
