Appellant brought this suit in the Jefferson circuit court against appellee, City of Louisville, to recover of it for personal injury received by appellant by falling over a rock partly imbedded in the sidewalk, or a space of ground alleged by him to be the sidewalk, of the city on the north side of Hill street near 15th street. He bases his action upon the theory that the city negligently failed to keep the sidewalk in proper repair and safe condition for use of pedestrians, and that the city knew or, by the exercise of ordinary care, could…
