I. STATEMENT OF THE CASE
On September 29, 1964, the body of twelve-year old Edith Connor was found in a narrow alley behind petitioner’s shoe repair shop on 40th Street in Philadelphia. The properties along 40th Street had rear wooden fences with a door leading from the back yard into the three-foot wide alley. In the opinion of the Pennsylvania Supreme Court (Commonwealth v. Thomas, 448 Pa. 42, 292 A.2d 352 (1972)), the following narrative appeared:
