This suit was instituted in the lower court by appellants, Maurice O. Wilkins, Jr., Katherine Wilkins Pennington, and Marice Wilkins Paladino, against their father, appellee, Maurice O. Wilkins, Sr., and their sister, Virginia Sue Wilkins. They alleged in their complaint that they and their father and sister were tenants in common of certain lands by virtue of a deed executed by their paternal grandfather on February 16, 1923; and they prayed for a partition of these lands.
