This is an application for the writ of mandamus directing the judge of the Circuit Court for Butler County to allow an appeal to this court in a case lately pending in that court wherein J.W. Waters is plaintiff and this relator is defendant, instituted in that court and returnable to its January term, 1922. As originally brought Callahan Construction Company was joined as a co-defendant, but it was dismissed as to it and proceeded against this relator alone.
