Memorandum by the Court,

Appeal from a judgment in the amount of $3,570 after trial without a jury in Albany County Supreme Court. The sole issue is whether or not the judgment is excessive. It appears that the plaintiff expended the sum of $95 for medical expenses, of which $80 was for 11 visits to his family doctor. The plaintiff testified to lower back pain from time to time following the automobile accident and that at one point the pain was so severe that he could not move the lower part of his body.
