MEMORANDUM DECISION AND ORDER

WINDER, District Judge.

This matter is before the court on the parties’ cross motions for summary judgment. Neither party requested oral argument but each has submitted a memorandum. The plaintiff is acting pro se and the defendants are represented by Glen R. Dawson and Peter Stirba.
